1. Acceptance of Terms
By accessing or using DropPing ("the Service"), operated by the entity identified in our Impressum, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
DropPing provides product availability monitoring and notification services. We monitor product pages on third-party retailer websites and send alerts when products become available or when prices change. The Service does not provide automated purchasing, checkout automation, or bot services.
3. User Accounts
3.1 Registration: To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3.3 Age Requirement: You must be at least 16 years old to use this Service. By using the Service, you represent that you meet this age requirement.
4. Subscription and Payments
4.1 Free and Paid Plans: The Service offers both free and paid subscription plans. Paid plans provide additional features and higher usage limits as described on our pricing page.
4.2 Billing: Paid subscriptions are billed in advance on a monthly basis. Payment is processed through Stripe, a third-party payment processor. By subscribing, you agree to Stripe's terms of service.
4.3 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
4.4 Price Changes: We reserve the right to change subscription prices. Any price changes will be communicated to you at least 30 days in advance and will apply to the next billing cycle.
4.5 Right of Withdrawal (EU): As a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason. However, by using the Service immediately after purchase, you acknowledge that you lose your right of withdrawal once the Service has been fully performed.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Use the Service to send spam or unsolicited communications
- Resell or redistribute the Service without authorization
- Use the Service in conjunction with automated purchasing bots
- Circumvent any usage limits or restrictions
6. Intellectual Property
The Service, including its original content, features, and functionality, is owned by the operator and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without express written permission.

The Service monitors third-party retailer websites. We are not affiliated with these retailers and are not responsible for their products, services, or availability. Product information displayed through the Service is provided for informational purposes only and may not be accurate or up-to-date.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THAT ALERTS WILL BE DELIVERED INSTANTLY OR THAT YOU WILL BE ABLE TO PURCHASE ANY MONITORED PRODUCTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless the operator and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
13. Governing Law and Dispute Resolution
13.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
13.2 Jurisdiction: Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Germany.
13.3 EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
